In order to ensure transparency and give you more control over your personal information, this privacy policy (“Privacy Policy”) governs how we, Yomu Inc. (“Magic Bookmark”, “we”, “our” or “us”) collect, use and store personal information that we collect or receive from or about you (“you”) in connection with the Magic Bookmark mobile application and any other version of the service we make available (together, the “App” or the “Service”). The App is intended for users aged 13 or over. Capitalized terms used but not otherwise defined herein shall have the meanings ascribed to them in the Magic Bookmark Terms of Service (the “Agreement”).
This Privacy Policy covers the Magic Bookmark App. The yomu.com website and the YOMU app are covered by the separate YOMU Privacy Policy available at https://yomu.com/app/app-privacy/.
We greatly respect your privacy, which is why we make every effort to provide a service that lives up to the highest user privacy standards. Please read this Privacy Policy carefully, so you can fully understand our practices in relation to personal information. Important note: Nothing in this Privacy Policy is intended to limit in any way your statutory rights, including your rights to a remedy or other means of enforcement.
More simply put: This document explains what information Magic Bookmark collects, why, and what we do with it. It covers the Magic Bookmark app only.

WHAT PERSONAL INFORMATION WE COLLECT, WHY WE COLLECT IT, AND HOW IT IS USED

When you browse the App without an account.
- We Process the Following Personal Information: We automatically collect certain information through your use of the App, such as device identifiers, Internet protocol (IP) address, device and hardware type, operating system, language, and information about actions taken within the App.
- Purpose for Processing: To operate the App, review and improve its usage and operations, analyze trends, and administer the Service.
- Consequences: If you do not provide this data, certain features of the App may not be available.
More simply put: You can look around without an account, and while you do we collect the standard technical data almost every app collects to work and improve.

When you create an account and when you log in.
- We Process the Following Personal Information: Your email address and the one-time login codes we send to it. Magic Bookmark does not use passwords.
- Purpose for Processing: To create your account, sign you in, restore your Bookmark balance and reading data across devices, and provide features available to registered users.
- Consequences: If you do not provide this data, we cannot create an account or maintain your balance and progress.
More simply put: Sign-up is just your email. We send you a code instead of making you invent a password.

When you use the App.
- We Process the Following Personal Information: The books you activate, your reading positions, your Bookmark balance and transactions, the companion content generated for you, and any other information you decide to provide us with in the course of your use of the App.
- Purpose for Processing: To provide the Service, including generating spoiler-bounded companion content for your position in a book, maintaining your balance and progress across devices, and improving the App.
- Consequences: If you do not provide this data, we cannot provide or maintain the Service.
More simply put: We keep track of which books you activated, where you are in them, and your Bookmark balance, because that is literally the product.

When you photograph a page of your book.
- We Process the Following Personal Information: Photographs you take of book pages, and text extracted from them through optical character recognition (OCR).
- Purpose for Processing: To identify your position in the book so the App can bound companion content to what you have already read, and to provide, secure, and improve the page-matching feature.
- Consequences: If you do not photograph pages, you can set your reading position manually instead.
More simply put: Photograph a page and we read it with OCR to find where you are. We keep the photos, and Section 3 explains for how long. If you prefer, skip the camera and enter your position by hand.

When you use conversational features.
- We Process the Following Personal Information: Where conversational features such as Character Chat are offered, we process the messages you send and the responses generated for you.
- Purpose for Processing: To provide the conversational feature, and to moderate it: conversations may be reviewed, including through automated systems and, where needed, by our personnel, for safety, abuse prevention, enforcement of the Agreement, and service improvement.
- Consequences: If you do not provide this data, conversational features will not be available to you.
More simply put: Chat messages are processed to generate replies, and chats can be reviewed to keep the feature safe. Do not put anything in a chat you would not want a moderation system to see.

When you make a purchase.
- We Process the Following Personal Information: When you purchase through a platform provider such as Apple, the payment is processed by that provider and we do not receive your payment card details; we receive transaction confirmations and manage your resulting Bookmark balance or subscription entitlement. Where we offer purchases directly, payments are processed by our payment processor.
- Purpose for Processing: To deliver what you purchased, maintain your entitlements, and comply with financial record-keeping obligations.
- Consequences: If you do not provide this data, we cannot process purchases.
More simply put: Apple handles the actual payment, so we never see your card. We just get told the purchase happened so we can credit your account.

When you contact us.
- We Process the Following Personal Information: Your email address and any other information you decide to provide us with, such as the content of your request.
- Purpose for Processing: To process and answer questions and provide support.
- Consequences: If you do not provide this data, we cannot process and answer your questions or provide support.
More simply put: If you email us, we use your message to help you.

AI PROCESSING OF YOUR INFORMATION
Companion content in Magic Bookmark, including recaps, character guides and, where offered, conversational features, is generated by artificial intelligence (large language models). To generate this content, we use third-party AI providers, and we may change providers from time to time. This means that information needed to provide the Service, which may include book-derived text, your reading position, and messages you send in conversational features, is processed by such providers on our behalf and under our instructions. We share with AI providers only what is needed to generate your content, and we do not share your email address or account credentials with them for this purpose.
More simply put: Outside AI companies do the actual generating, so the relevant text, your position, and your chat messages pass through their systems on our behalf. They get what is needed to write your recap, not your account details.

HOW WE PROTECT AND RETAIN YOUR PERSONAL INFORMATION
- Security. We implement and maintain industry-standard technical, organizational and security measures designed to protect your personal information. However, please note that we cannot guarantee that personal information will not be compromised as a result of unauthorized penetration of our servers. As the security of information depends in part on the security of the device you use to communicate with us and of your email account, please make sure to take appropriate measures to protect them.
- Retention. Your personal information is retained for as long as your account exists and as reasonably necessary to provide the Service, after which it is deleted or anonymized, except where we are required to retain it longer under legal, regulatory, tax or accounting requirements, to maintain an accurate record of dealings in the event of complaints or challenges, or where we reasonably believe there is a prospect of litigation.
- Page photographs. We retain page photographs for as long as reasonably necessary to provide, secure, and improve the page-matching feature and to resolve support issues. Page photographs are deleted when you delete your account, and you may request earlier deletion of your photographs at any time as described in Section 5.
More simply put: We protect your data with industry-standard measures, keep it while your account is active, and delete it when the account goes, including your page photos. You can also ask us to delete your photos sooner.

HOW WE SHARE YOUR PERSONAL INFORMATION
- We use third-party service providers to process your personal information for the purposes outlined above, including, without limitation:
- With cloud service providers for hosting purposes;
- With third-party AI providers, as described in Section 2;
- With payment processing service providers; purchases made through Apple are processed by Apple under Apple’s own privacy policy;
- With email delivery, lifecycle messaging, and similar tool providers;
- With analytics and attribution companies, in order to help us understand and analyze information we collect in accordance with this Privacy Policy, as described in Section 7.
- To the extent necessary, with regulators, courts, banks or competent authorities, to comply with applicable laws, regulations and rules, and requests of law enforcement, regulatory and other governmental agencies, as well as for internal compliance procedures and to protect the safety, security, and integrity of Magic Bookmark, our Service, customers, employees, property, and the public.
- We may disclose personal information to our lawyers, accountants, auditors and other professional advisors where necessary to obtain legal or other advice or otherwise protect and manage our business interests.
- We may use or disclose personal information to investigate, prevent, or take action regarding illegal activities, suspected fraud, cybersecurity threats, situations involving potential threats to the physical safety of any person, or violations of this Privacy Policy or the Agreement, or as otherwise required or allowed by law.
- If, in the future, we sell or transfer, or consider selling or transferring, some or all of our business, shares or assets to a third party, we will disclose your personal information to such third party (whether actual or potential) in connection with the foregoing events. In the event that we are acquired by, or merged with, a third party entity, or in the event of bankruptcy or a comparable event, we reserve the right to transfer, disclose or assign your personal information in connection with the foregoing events.
- Where you have otherwise provided your consent to us for sharing or transferring your personal information.
- Magic Bookmark does not sell, rent, or share any personal information, including automatically collected information, for advertising or commercial purposes. We do not use or permit third-party behavioral, contextual, or targeted advertising within the App.
More simply put: Your data goes to the vendors that run the service (hosting, AI, payments, analytics, messaging), to authorities when the law requires, and to advisors when needed. We do not sell your data and there are no ads in the App.

YOUR PRIVACY RIGHTS
- The following rights (which may be subject to certain exemptions or derogations) apply to certain individuals, some of which only apply to individuals protected by specific laws:
- You have the right to withdraw consent to processing, where consent is the basis of processing.
- You have the right to request access to your personal information held by us, along with details on how it is processed, and the right to rectification of inaccurate personal information about you.
- You have the right to object to unlawful data processing under certain conditions.
- You have the right to erasure of past personal information about you (your “right to be forgotten”) under certain conditions.
- You have the right to demand that we restrict the processing of your personal information under certain conditions.
- You have the right to data portability of personal information concerning you that you provided us, in a structured, commonly used, and machine-readable format, subject to certain conditions.
- You can exercise your rights by contacting us at support@yomu.com. You may use an authorized agent to submit a request on your behalf if you provide the authorized agent written permission signed by you. To protect your privacy, we may take steps to verify your identity before fulfilling your request. Subject to legal and other permissible considerations, we will make every reasonable effort to honor your request promptly in accordance with applicable law or inform you if we require further information in order to fulfil your request.
- Deleting your account: You can delete your account at any time from within the App, or by emailing us at support@yomu.com. Upon deletion, the personal information associated with your account is deleted as described in Section 3, and any remaining Bookmark balance and entitlements are forfeited as described in the Agreement. Please note that we may retain certain records post deletion in accordance with applicable laws.
More simply put: You can ask to see, fix, export, restrict, or delete your data by emailing support@yomu.com, and you can delete your whole account right in the App. Deleting your account also deletes your data and forfeits unused Bookmarks, as the Terms explain.

INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION
In order to run our business and provide our Service to you, we transfer personal information to certain countries around the world, including to our service providers, many of whom may be located outside of your jurisdiction. Therefore, your personal information may be processed in countries with privacy laws that are different from privacy laws in your country. Whenever personal information is transferred internationally, we ensure it is protected by using Standard Contractual Clauses or other lawful mechanisms, including making sure the destination country has been deemed to provide an adequate level of protection for personal information, and/or by executing data onward transfer instruments such as data processing and protection agreements.
More simply put: Our vendors are in different countries, so your data can cross borders, and we use the standard legal safeguards when it does.

ANALYTIC TOOLS
- Mixpanel. We collect personal information such as your user activity through the use of Mixpanel. Mixpanel’s ability to use and share personal information is governed by the Mixpanel Terms of Use, available at https://mixpanel.com/terms/, and the Mixpanel Privacy Policy, available at https://mixpanel.com/privacy/. You can opt out of Mixpanel’s services at https://mixpanel.com/optout/.
- Singular. We use Singular for mobile attribution, to understand how users discover the App. Singular may process device identifiers and install and event data. Singular’s use of personal information is governed by its privacy policy, available at https://www.singular.net/privacy-policy/.
- Customer.io. We use Customer.io to send messages such as email and push notifications and to manage lifecycle communications. Customer.io may process your email address, device identifiers, and message interaction data. Customer.io’s use of personal information is governed by its privacy policy, available at https://customer.io/privacy-policy. You can opt out of marketing messages through the unsubscribe option in our emails and adjust push notifications in your device settings.
- We use log files and use such information to analyze trends, administer the Service, and track usage of the Service.
- We reserve the right to remove or add new analytic tools and tracking technologies.
More simply put: We use Mixpanel to understand how the App is used, Singular to understand where new users come from, and Customer.io to send you emails and notifications. Each has an opt-out, and marketing emails always have an unsubscribe link.

INTERACTION WITH THIRD PARTY PRODUCTS
The App may enable you to interact with websites, applications, products or services that are not owned or controlled by us (each, a “Third Party Service”), such as the platform through which you obtained the App. We are not responsible for the privacy practices or the content of such Third Party Services, which can collect personal information from you. We encourage you to read the terms and privacy policies of each Third Party Service.
More simply put: Other companies’ services connected to the App follow their own privacy rules, not ours.

CHILDREN’S PRIVACY
The App is intended for users aged 13 or over, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us at support@yomu.com and we will delete such information as required by applicable law.
More simply put: Magic Bookmark is for ages 13 and up. If a younger child’s data somehow ends up with us, tell us and we will delete it.

CHANGES TO THIS PRIVACY POLICY
This Privacy Policy can be updated from time to time and, therefore, we ask you to check back periodically for the latest version. If we implement material changes to the way we use your personal information, in a manner that is different from that stated at the time of collection, we will notify you by posting a notice in the App or on our website or by other means and take any additional steps as required by applicable law.
More simply put: If we change how we handle your data in a meaningful way, we will tell you.
